VIBRANT WAVE PRODUCTIONS Terms of Service & Copyright Agreement

By completing a booking with Vibrant Wave Productions, you ("Client") agree to be bound by the following Terms of Service and Copyright Agreement. Please read this document carefully before confirming your appointment.
Vibrant Wave Productions ("VWP") is a luxury real estate media company providing professional photography, cinematic videography, drone imagery, and social media content for real estate marketing purposes. All services are performed by VWP on behalf of licensed real estate agents, brokers, and property sellers.
VWP offers the following services, available individually or as part of a bundled package:
- Real Estate Photography (interior, exterior, and detail shots) - Cinematic Video Production (walkthrough and highlight reels) - Drone Photography & Videography (aerial imagery, FAA-compliant) - Golden Hour / Twilight Photography - Social Media Content (short-form video and optimized still imagery)
The specific services included in your booking are confirmed at the time of purchase. Any services not included in your confirmed package are outside the scope of your booking and are subject to separate pricing and written approval.
Raw or unedited files are not included in any package and are not available for purchase.
3.1 Confirmation Your booking is confirmed upon completion of the online booking process and receipt of full payment. VWP reserves the right to decline any booking at its discretion.
3.2 Payment Full payment is due before downloading or accessing your delivered files. A payment link will be provided alongside your download link upon project completion. Files will not be accessible until payment has been received and confirmed. All prices listed on this website are in U.S. dollars.
3.3 Pricing Prices are subject to change without notice. The price displayed at the time of your confirmed booking is the price you will pay. Existing confirmed bookings are not affected by subsequent price changes.
4.1 Client Cancellations - Cancellations made 72 hours or more before the scheduled shoot will receive a full refund. - Cancellations made within 72 hours of the scheduled shoot are non-refundable. At VWP's discretion, a credit toward a future booking may be offered.
4.2 Rescheduling Rescheduling requests made 72 hours or more in advance will be accommodated at no charge, subject to availability. Rescheduling within 72 hours of the shoot may be treated as a cancellation per the policy above.
4.3 VWP Cancellations In the rare event VWP must cancel due to illness, equipment failure, or other unforeseen circumstances, you will receive a full refund or the option to reschedule at no additional charge.
4.4 Weather & Drone Operations All drone operations are conducted in compliance with FAA regulations. If weather or airspace conditions prevent safe or compliant drone operations, VWP will reschedule the drone portion of the shoot at no additional cost. Ground-level services will proceed as scheduled unless weather conditions are deemed unsafe for all parties. Drone-specific cancellations do not entitle the Client to a refund of non-drone services.
5.1 Preparation The Client is responsible for ensuring the property is accessible, staged, and ready for photography and video at the scheduled shoot time. This includes but is not limited to: lights on throughout the property, personal items and clutter cleared from all rooms, vehicles removed from driveways and visible areas, and appropriate access provided to VWP upon arrival.
5.2 Delay Fee If the property is not ready or accessible within 20 minutes of the scheduled start time, VWP reserves the right to assess a delay fee of $50, or to treat the booking as a cancellation per Section 4.1.
5.3 Property Permission By booking VWP, the Client warrants that they have the legal authority or permission of the property owner to authorize photography and videography of the property.
Edited deliverables will be provided via a digital download link within the timeframe specified at the time of booking. Turnaround times are estimates and may vary based on project complexity and scheduling. VWP will communicate any significant delays promptly.
Each booking includes one (1) round of minor revisions, defined as reasonable adjustments such as color correction changes, removal of specific shots, or music selection updates for video. Requests for significant re-edits, reshoots, or additional revision rounds are subject to a separate fee, which will be communicated in advance.
Revision requests must be submitted within 5 business days of delivery. After this period, the project is considered complete and further revisions are subject to additional charges.
8.1 Ownership Vibrant Wave Productions retains full copyright ownership of all photographs, video, and other media created during your shoot. This includes but is not limited to raw files, edited deliverables, and any derivative works.
8.2 License Granted to Client Upon completion of your booking and delivery of files, VWP grants you a non-exclusive, non-transferable, perpetual license to use the delivered media for lawful real estate marketing and promotional purposes related to the listed property. Permitted uses include MLS listings, social media, digital advertising, print materials, and client-facing marketing.
8.3 Restrictions The Client may not: - Resell, sublicense, or transfer the media to any third party for their own commercial use - Claim authorship or ownership of the media - Use the media for purposes unrelated to the marketing of the property without prior written approval from VWP - Remove or alter any watermarks, metadata, or copyright notices embedded in the files
8.4 Portfolio & Marketing Rights VWP reserves the right to use any media created under this Agreement in its own portfolio, website, social media channels, and marketing materials. If you prefer that your property's media not be used for this purpose, please notify VWP in writing before or at the time of your shoot.
8.5 Third-Party Usage If the media is shared with or used by a third party (e.g., a co-listing agent, brokerage, or staging company), the Client is responsible for ensuring that third party complies with the terms of the license granted herein.
VWP operates all drone equipment in full compliance with applicable FAA regulations, including Part 107 rules governing commercial drone operations. The Client is responsible for disclosing any known airspace restrictions, HOA prohibitions, local ordinances, or property-specific limitations that may affect drone operations prior to the shoot date. VWP is not liable for delays or cancellations resulting from undisclosed restrictions.
VWP's total liability to the Client under these Terms shall not exceed the total fees paid for the applicable booking. VWP is not responsible for consequential, incidental, or indirect damages of any kind, including lost revenue from listing delays. In the event of data loss or file corruption, VWP will make every reasonable effort to recover or recreate the affected media at no additional charge.
Any personal information collected during the booking process (name, email, phone number, property address) is used solely for the purpose of fulfilling your booking and communicating with you about your project. VWP does not sell or share your personal information with third parties. For more information, please refer to our Privacy Policy.
These Terms of Service are governed by the laws of the State of Nevada. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Nevada.
VWP reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our booking services after any changes constitutes acceptance of the revised Terms.
